1. Scope
These Terms and Conditions (“T&C”) apply to all orders and purchases made through the online shop operated at https://worldarts.company (the “Shop”). The Shop is operated from Portugal and offers EU wide delivery.
These T&C apply to the sale of both physical artworks and digital products, including but not limited to non-fungible tokens (NFTs). By placing an order or purchasing an NFT, you agree to be bound by these T&C in the version valid at the time of the transaction.

3. Products
The Shop offers original physical artworks, limited editions, and digital artworks, including NFTs.
Physical artworks are unique or limited in nature. Minor variations in color, texture, size, or appearance may occur due to artistic processes, photography, or display settings and do not constitute a defect.
NFTs are digital assets recorded on a blockchain. The purchase of an NFT does not grant any intellectual property rights beyond those explicitly stated. Ownership of an NFT represents ownership of the token itself, not necessarily the underlying artwork or copyright.
4. Ordering Process
The presentation of products in the Shop does not constitute a legally binding offer but an invitation to place an order. By clicking the purchase button, you submit a binding offer to buy the selected products. A contract is concluded when you receive an order confirmation by email.
5. Prices and Payment
All prices are displayed in the Shop and are exclusive or inclusive of applicable taxes as indicated. Shipping costs, customs duties, and import taxes (if applicable) are shown separately during checkout.
Payment methods offered in the Shop may include credit card, bank transfer, and other payment providers. Payment is due immediately upon order confirmation unless otherwise agreed.
6. Delivery and Shipping
Physical artworks are shipped to the delivery address provided by the customer. Delivery times are estimates unless expressly stated as binding.
Worldwide shipping is offered. Customers are responsible for any customs duties, import taxes, local fees, or other charges incurred in the destination country.
Risk of loss or damage for physical goods passes to the customer upon handover to the shipping provider, unless mandatory consumer protection laws provide otherwise.
NFTs and other digital products are delivered electronically via blockchain transfer or digital access. Delivery is deemed completed once the NFT has been successfully transferred to the wallet address provided by the customer.
7. Right of Withdrawal (Consumers Only)
If you are a consumer, you may have a statutory right of withdrawal for physical goods within 14 days of receipt, unless the right of withdrawal is excluded by law.
The right of withdrawal does not apply to:
- Customized or commissioned artworks
- Digital products, including NFTs, once delivery has begun or the token has been transferred

8. Returns and Refunds
Returns and refunds for physical artworks are subject to the conditions set out in our Refund Policy, which will be made available on this website.
Unless otherwise stated, return shipping costs are borne by the customer. Returned items must be in their original condition and packaging.
NFTs and other digital products are non-refundable once delivered, except where mandatory law requires otherwise.
9. Intellectual Property
All artworks, images, texts, and content displayed in the Shop are protected by copyright and other intellectual property laws.
Purchasing a physical artwork does not transfer any copyright or reproduction rights unless explicitly agreed in writing.
9.1 NFT License
Upon purchase of an NFT from the Shop, the buyer receives a limited, non-exclusive, non-transferable, and royalty-free license to use the underlying digital artwork solely for personal, non-commercial purposes, unless explicitly stated otherwise.
This license allows the buyer to:
- Display the artwork for personal use (e.g., on personal devices, virtual galleries, or social media, provided proper attribution is given where technically feasible)
- Transfer the NFT to a third party, whereby this license automatically terminates and, if applicable, may be granted anew to the subsequent holder
The license does not allow the buyer to:
- Use the artwork for commercial purposes
- Modify, reproduce, distribute, or create derivative works from the artwork
- Use the artwork in connection with advertising, branding, or merchandise
All intellectual property rights, including copyrights and exploitation rights, remain with the artist or rights holder unless explicitly transferred in writing.
Ownership of the NFT represents ownership of the token recorded on the blockchain and does not itself constitute ownership of the underlying artwork or its intellectual property.
10. Liability
To the extent permitted by law, we exclude liability for slight negligence. Liability for gross negligence, willful misconduct, and mandatory statutory claims (such as product liability) remains unaffected.
11. Warranty
Statutory warranty rights apply. Any additional warranties are only valid if expressly stated.
12. Data Protection
Personal data is processed in accordance with applicable Portuguese data protection laws and, where applicable, the EU General Data Protection Regulation (GDPR).

13. Governing Law and Jurisdiction
These T&C are governed by the substantive laws of Portugal, excluding its conflict-of-law rules.
The place of jurisdiction shall be the registered office of the seller, unless mandatory consumer protection laws provide otherwise.
14. Severability
If any provision of these T&C is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
15. Amendments
We reserve the right to amend these T&C at any time. The version valid at the time of the order shall apply.
